TransApp Partner App Terms of Use

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.


Background

These Terms of Use, together with any referenced documents, set out the terms of use under which you may use the TransApp Partner Application (“Our Application”).

By registering as a Partner with TransApp, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you may not use the TransApp Partner App.

By using TransApp services, you become a Service Provider on the TransApp platform and agree to be bound by these Terms. We may amend these Terms at any time by posting the updated version in the Application. Continued use of the Application means you accept the changes.

These Terms of Use do not apply to the sale of services.


Definitions

  • Account – An account required for a Partner to access and/or use certain areas of the Application.

  • Content – Any and all text, images, audio, video, code, databases, and other information on the Application.

  • TransApp Agent – An independent business or individual operating as a mobile money agent or service agent for TransApp.

  • TransApp – All versions of the TransApp applications.

  • TransApp Wallet – The wallet balance owed to a TransApp Agent as the result of services provided to Users.

  • TransApp Support Desk – In-person and call-center support available to current and prospective TransApp Agents.

  • Service Provider – Any individual or business, including Agents, offering goods or services to Users on TransApp.

  • User – A customer or consumer of TransApp services.

  • User Content – Any content submitted to the Application by Users, including personal information, images, and data.

  • We/Us/Our – TransApp and its authorized operators or licensees.


Our Application

  1. Any individual or business seeking to become a TransApp Partner/Agent must first apply and pass all necessary requirements, including onboarding, KYC checks, and legal compliance.

  2. Only approved TransApp Agents may access the Partner Application.

  3. TransApp reserves the right to conduct background checks and suitability assessments before and during partnership.

  4. We may suspend or stop access at any time without liability.

  5. Partners are responsible for making all arrangements necessary to access the Application.

  6. Access is provided “as is” and “as available.” TransApp may alter, suspend, or discontinue the Application at any time without liability.

  7. Partners may not subcontract obligations without prior written approval from TransApp.


Terms of Use

  1. Partners remain independent businesses. Registration with TransApp does not create an employment relationship.

  2. We are not liable for actions, conduct, or disputes involving Partners or Users.

  3. Partners must exercise caution, professionalism, and good judgment when using TransApp.

  4. TransApp is not liable for damages, injuries, death, or disputes resulting from interactions between Partners and Users.

  5. Partners must adhere to the TransApp Code of Conduct, provided during onboarding.

  6. Pricing for services is set transparently by TransApp. Agents must accept platform pricing. Any disputes must be raised with the Support Desk.

  7. Incentives, penalties, or promotions may be introduced and communicated through SMS, in-app notifications, or official notices.

  8. TransApp may charge commissions or service fees, communicated in advance.

  9. Partners are responsible for staying informed about changes to pricing, fees, and incentives.


Accounts

  1. Approved Partners receive a TransApp Account.

  2. Information provided must be accurate and kept updated.

  3. Partners are responsible for securing login details.

  4. Unauthorized access or use of another Partner’s account is prohibited.

  5. Personal information is collected and processed in line with the Data Protection and Privacy Act, 2019.

  6. TransApp may suspend or deactivate an Account at any time in case of breach.


Earnings and Payments

  1. Earnings can be monitored through the TransApp Wallet.

  2. Payouts are made via mobile money, bank transfer, or other approved channels.

  3. Withdrawal fees may apply.

  4. Partners must report payment issues promptly.

  5. TransApp may deduct overpayments or outstanding balances from future earnings.


TransApp Equipment

  1. Partners may receive branded equipment (e.g., reflectors, devices, or materials).

  2. Equipment remains the property of TransApp unless explicitly purchased.

  3. Partners must care for and return equipment when no longer active.

  4. Misuse of equipment (e.g., on competing platforms) may result in suspension and penalties.

  5. Lost or damaged equipment may attract replacement fees.


Intellectual Property

All materials, software, and content in the Application remain the property of TransApp. Partners may not copy, distribute, or exploit them without written permission.


Data Protection & Security

  1. Partners must comply with Uganda’s Data Protection and Privacy Act, 2019.

  2. Partners must implement safeguards to protect personal data obtained through the platform.

  3. Data must not be shared, transferred, or processed unlawfully.

  4. Confidentiality must be maintained at all times.


Acceptable Usage

Partners must NOT:

  • Use the Application for illegal or fraudulent activities.

  • Harass, harm, or endanger Users.

  • Manipulate transactions.

  • Submit offensive, abusive, or discriminatory content.

Violations may result in suspension, deactivation, or legal action.


Liability Disclaimer

  • TransApp is a technology platform and does not directly provide services.

  • We are not liable for accidents, damages, or disputes unless caused by proven negligence.

  • Partners use the Application at their own risk.


Governing Law

These Terms are governed by the laws of Uganda. Disputes shall be resolved by the courts of Uganda.
