TransApp Driver Terms and Conditions
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.
Background
These Terms of Use, together with any referenced documents, set out the terms under which you may use the TransApp Driver Application (“Our Application”).
By registering as a Driver with TransApp, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you may not use TransApp.
By using TransApp services, you become a Service Provider on the TransApp platform and agree to be bound by these Terms. We may amend these Terms at any time by posting the updated version in the Application. Continued use of the Application means you accept the changes.
Definitions

Account – A driver profile required to access and use TransApp.

Driver – An independent provider of transport or delivery services using TransApp.

TransApp – All versions of the TransApp applications and systems.

TransApp SmarTCab Driver – A driver providing cab services through TransApp.

TransApp SmarTBike Rider – A rider providing motorcycle transport or deliveries.
-
TransApp SmarTDel Courier – A provider offering delivery services through TransApp.
-
TransApp Wallet – Balance of earnings due to a Driver through the platform.
-
Service Provider – Any registered Driver, Rider, or Courier offering services.

User – A passenger or customer booking services on TransApp.
-
We/Us/Our – TransApp and its authorized operators or licensees.
Becoming a TransApp Driver

Drivers must apply and pass all requirements, including:

Identity verification.

Background checks.
-
Training sessions either directly or indirectly.
-
Vehicle or motorcycle inspection.
-

Only approved Drivers may access the TransApp Driver Application.

We may suspend or terminate access at any time for non-compliance.
Terms of Use

Independent Contractor – Drivers remain independent business people. Using TransApp does not create an employment relationship.

Responsibility – Drivers are solely responsible for their actions, conduct, and service quality.

Safety & Conduct – Drivers must follow road safety rules, act professionally, and adhere to the TransApp Driver Code of Conduct (provided during registration).

Liability – TransApp is not responsible for disputes, accidents, delays, or damages arising from rides or deliveries. Drivers use the platform at their own risk.

Pricing – Trip fares are calculated by the TransApp system. Drivers must accept platform pricing and cannot charge Users outside the Application.

Incentives & Penalties – From time to time, TransApp may offer bonuses, promotions, or apply penalties for poor performance. These will be communicated via SMS, app notifications, or official notices.

Insurance – Where available, qualifying Drivers may benefit from platform-provided insurance cover in line with applicable policies.

Commission – TransApp charges a commission on each completed trip or delivery. The rate will be communicated to Drivers in advance and may change from time to time.
Driver Accounts

Approved Drivers will be issued with a unique Account.

All information provided must be accurate and kept up to date.

Drivers are responsible for securing their login details.

Unauthorized use of another Driver’s account is prohibited.

TransApp may suspend or deactivate Accounts in case of fraud, misconduct, or breach of Terms.
Earnings and Payments

Drivers can track their earnings through the TransApp Wallet.
-
Payments are settled via mobile money, bank transfer, or other methods as communicated.
-
Withdrawal fees may apply to cover processing costs.

Drivers must promptly report payment issues to the TransApp Support Desk.

TransApp reserves the right to deduct overpayments or outstanding balances from future earnings.
TransApp Equipment

Drivers may be provided with branded equipment (helmets, jackets, or digital devices).
-
Equipment remains the property of TransApp unless stated otherwise.

Drivers must return equipment if they stop using the platform.
-
Lost or damaged equipment may attract replacement fees.
-
Misuse of TransApp equipment (e.g., using it on competing platforms) may result in account suspension.
Acceptable Usage
Drivers must NOT:

Use the Application for illegal or fraudulent purposes.

Harass or endanger passengers or other road users.
-
Manipulate trip or delivery requests.
-
Use abusive, offensive, or discriminatory language.
Violations may result in suspension, permanent deactivation, or legal action.
Intellectual Property
All software, designs, and materials in TransApp remain the property of TransApp. Drivers may not copy, resell, or exploit them for personal gain.
Liability Disclaimer

TransApp is a platform and does not directly provide transport or delivery services.

We are not liable for accidents, loss, injury, or disputes unless caused by proven negligence.

Drivers must exercise caution and good judgment when interacting with Users.
Changes to Terms
We may revise these Terms at any time. The latest version will always be available in the Application. Continued use of TransApp after updates means acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of Uganda. Disputes shall be resolved by the courts of Uganda.
