Website and App Terms of Use

Background

These Terms of Use, together with any other referenced documents, set out the terms under which you may use the TransApp mobile application and website (together, “Our Application”).

By signing up for a TransApp Account, you confirm that you have carefully read, understood, and accepted these Terms of Use. If you do not agree to these Terms, you must not use our Application or Services.

By using TransApp services (SmarTCab, SmarTBike, SmarTDel), you agree to be bound by these Terms. We may update these Terms at any time by posting the revised version on our Application. Continued use of TransApp after changes are made means you accept the updated Terms.


Definitions and Interpretation

  • Account – A user profile required to access and use certain parts of the TransApp Application.

  • Content – Any text, images, video, audio, code, or data displayed on or forming part of Our Application.

  • Service Provider – Drivers, riders, or couriers offering transport or delivery services through TransApp.

  • TransApp – All versions of the TransApp applications and website.

  • User – Any person using the TransApp Application, whether booking rides, deliveries, or other services.

  • User Content – Any information or material submitted to TransApp by Users, such as personal details, images, or reviews.

  • We/Us/Our – TransApp and its authorized operators or licensees.

Access to Our Application

  1. Downloading and accessing TransApp is free of charge.

  2. You are responsible for securing internet access and compatible devices.

  3. Access is provided on an “as is” and “as available” basis. We may suspend, modify, or withdraw the Application at any time without notice.

  4. We reserve the right to suspend or terminate your access if you misuse our Application or violate these Terms.


Terms of Use

  1. Platform Role – TransApp is a technology platform that connects Users with Service Providers (drivers, riders, couriers). We do not directly provide transportation or delivery services.

  2. Safety Commitment – TransApp emphasizes customer safety, reliability, and professionalism. Trips are trackable, and our drivers/riders are trained and vetted.

  3. Liability – TransApp is not responsible for disputes, accidents, delays, or loss of property unless caused by proven negligence. Users and Service Providers use the platform at their own risk.

  4. Disputes – While TransApp may help facilitate resolutions between Users and Service Providers, we are not responsible for the outcome of such disputes.


Accounts

  1. You must be 18 years or older to create an account.

  2. You must provide accurate and up-to-date personal information when signing up.

  3. You are responsible for maintaining the confidentiality of your account login details.

  4. If you suspect unauthorized access, notify us immediately.

  5. You may delete your account at any time via the Application settings.

  6. Data collected through your account is managed under our Privacy Policy.


Payments

  1. TransApp services are payable via cash, mobile money, or card.

  2. Prices are shown in the Application before booking.

  3. Users are responsible for completing payments for all services booked.

  4. TransApp reserves the right to suspend accounts with unpaid balances.


Intellectual Property Rights

  1. All content on TransApp (except User Content) is owned by or licensed to us.

  2. You may not copy, distribute, or commercially exploit content without our written permission.

  3. You may download or print materials for personal, non-commercial use.


User Content

  1. Users retain ownership of content they submit (e.g., reviews).

  2. By submitting content, you grant TransApp a worldwide, royalty-free license to use, display, and share it for service improvement and promotion.

  3. We may remove content that violates our policies, laws, or third-party rights.


Acceptable Usage Policy

When using TransApp, you agree NOT to:

  • Use the Application for unlawful or fraudulent purposes.

  • Harass, threaten, or harm other Users or Service Providers.

  • Upload harmful or malicious code (viruses, malware, etc.).

  • Impersonate another person or misrepresent your identity.

Violations may result in suspension or permanent termination of your account.


Liability and Disclaimers

  • TransApp provides access to Service Providers but does not guarantee service availability or timeliness.

  • We are not liable for indirect losses (e.g., missed opportunities, emotional distress).

  • Users must exercise caution when interacting with Service Providers.

  • We are not responsible for third-party applications or websites linked through our Application.


Privacy and Data

Use of TransApp is governed by our Privacy Policy, which explains how we collect, store, and protect your information.


Changes to These Terms

We may update these Terms at any time without prior notice. The latest version will always be available in the Application and on our website. Continued use of TransApp after updates means you accept the revised Terms.

Governing Law and Jurisdiction

These Terms of Use are governed by the laws of Uganda. Any disputes will be handled in the courts of Uganda.
